JudgeCo update 3: EU Cross-Border Insolvency Court-to-Court Cooperation Principles and Guidelines

After analysing the responses to the questionnaires set out, we decided to rename the ‘JudgeCo Principles and JudgeCo Guidelines’-project into “EU Cross-Border Insolvency Court-to-Court Cooperation Principles” and “EU Cross-Border Insolvency Court-to-Court Cooperation Guidelines”, in short EU JudgeCo Principles and EU JudgeCo Guidelines.

The EU JudgeCo Principles are roughly the result of Questionnaire 1. They have led to 26 Principles, contained in a document of (presently) some 65 pages. The EU JudgeCo Guidelines are roughly the results of Questionnaire 2, the responses which we received last October. The term guideline fits as the historic roots are the well know ALI Court-to-Court Guidelines. They have led to 18 Guidelines; in all a document of some 25 pages. Mid December the draft text (First non-public draft) was send for commentary to the Review & Advisory Group.

We hope to receive comments in January 2014. In keeping with our planning we would very much welcome your comments before 15 January 2014. Having reviewed the commentaries received we will then prepare a Second Non-Public Draft, again available for the members of the R&A-group. We trust to have ready a First Public Draft, which will be available for comments by other project-partners, such as the Members Advisory Committee of the International Insolvency Institute (III), our project co-sponsor. We try to publish the Final Public Draft of the JudgeCo Principles and the JudgeCo Guidelines in May 2014.
